We strictly adhere to and follow the bankruptcy petition preparer guidelines of the bankruptcy court pursuant to 11 U.S.C. § 110.  We understand that filing for bankruptcy can be a difficult and daunting process and our mission is to provide you with the best petition preparation service and to help you every step of the way by providing various resources for you to understand and get the knowledge you need prior to moving forward with a decision to file for bankruptcy without an attorney.

Consociates offers petition preparation services and under NO circumstances gives legal advice or suggestions concerning your bankruptcy case. Consociates has a duty to only prepare bankruptcy forms for you to personally file yourself as a pro se debtor with the court.  We do NOT file any bankruptcy cases with the court, we do NOT accept any court filing fees on behalf of any debtor. 

We are not attorneys and are prohibited by law NOT to explain or answer any questions in reference to any of the following (will not) statements below:

  • We will NOT provide advice whether to file a bankruptcy petition;

  • We will NOT provide advice concerning any bankruptcy procedure or any bankruptcy right;

  • We will NOT provide advice whether a debtor will be able to retain the debtor’s home, car, or other property after commencing a bankruptcy case;

  • We will NOT provide advice whether commencing a case under chapter 7, 11, 12, or 13 is appropriate;

  • We will NOT explain information necessary to complete the bankruptcy petition;

  • We will NOT advise or provide information regarding the claiming of exemptions;

  • We will NOT determine which debts are priority, secured, or unsecured type debts;

  • We will NOT use bankruptcy form software which selects which form information should be placed or selects exemptions;

  • We will NOT solicit information from the debtor via worksheet, questionnaire, internet website or other information gathering tool (except for the Official Bankruptcy Forms) to prepare the Official Bankruptcy Forms;

  • We will NOT suggest or determine where items belong on any document to be filed, including the petition, schedules, statement of financial affairs, the mean test form (Form B22), etc.;

  • We will NOT explain or discuss the benefits of, or problems that, a bankruptcy filing may have on debtor, including: i) regarding any foreclosure or eviction proceeding; or ii) whether any debt will be discharged, including outstanding student loans, taxes or domestic obligations; 

  • We will NOT provide advice whether debtor may or should promise to repay debts to a creditor or enter into a reaffirmation agreement with a creditor to reaffirm a debt;

  • We will NOT appear with the debtor or on a debtor's behalf at the Section 341(a) Meeting of Creditors to provide advice regarding the meeting or process;

  • We will NOT advise or suggest to a debtor procedural or legal actions that may or may not be taken by a creditor, United States Bankruptcy Trustee, United States Bankruptcy Court, United States Bankruptcy Judge, the case trustee or another party; and

  • We will NOT advise debtors to include or omit information from the bankruptcy forms.

 

Consociates only prepares petitions for Chapter 7 cases and require debtors who desire to utilize our services to complete a pro se bankruptcy clinic and provide proof of attendance before we render our bankruptcy petition preparation services. A valid email address and telephone number is required for communication purposes to complete petition preparation services. Consociates charges the allowable maximum amount of $125.00 for preparation of each bankruptcy petition pursuant to  11 U.S.C. § 110 of the bankruptcy code. No other fees will be charged in conjunction with petition preparation. Before work can began, we will request debtors to upload documents for bankruptcy petition to our secured file storage that will be sent to your by email as a link. All completed petitions will be submitted to debtors through our secured electronic link available for download with an expiration date, all case documents and petitions will be deleted from our system as soon as we receive confirmation that you have received your final petition. Consociates prepares bankruptcy petitions based on documents and information received from debtors and are not responsible for dismissals based on debtor negligence and lack of knowledge.
